Welcome! THE PILATES PARTY (“THE PILATES PARTY”, “us”, “our” or “we”), owns and operates this website, services, content, technologies and applications located at thepilatesparty.com (" Website"). These Terms of Use (“Terms”) constitute a legally binding agreement made by and between THE PILATES PARTY and the user of this Site (personally and, if applicable, on behalf of the entity for whom you are using the Site; collectively, “you”).

The Pilates Party Member Policies

Upon purchase of any THE PILATES PARTY session or membership plan, the purchaser agrees to the following company policies. We reserve the right to make changes to any of our policies at any time. As a user of the website you are agreeing to these policies and any future revisions during your membership term. As a company, we will do our best to inform our users of any adjustments made, however it is ultimately the responsibility of the purchaser to be aware and comprehend the following policies.

Cancellation Policy: Upon purchase of the Quarterly or Annual Memberships the purchaser is agreeing to pay the total sum of the 3 or 12 month membership in equal monthly installments, billed automatically each month on the same calendar date post purchase, or in lump sum. THE PILATES PARTY reserves the right to refuse cancellation to any Quarterly or Annual member.

A Monthly member may cancel their membership themselves at any time.

All a la carte purchases are final sale.

Refund Policy: We do not provide refunds for previous months, even if the member has not logged in. We also do not provide refunds for a la carte session even if the purchaser did not attend a class or session. If there is an issue with billing, it is the responsibility of the purchaser to alert the company of the error and maintain awareness of transactions posting to their account. THE PILATES PARTY maintains the right to refuse refund or provide the option to take THE PILATES PARTY credit to be used on future purchases.

Billing Policy: Our billing system is automated and we do not have the ability to freeze or skip payments or adjust the billing cycle for any of our members. Upon signup Pay by Month members will be billed automatically on the same calendar date each month.

Plan Expiration Policy: Upon expiration of any THE PILATES PARTY subscription your access will end without contact or action needed from the member. There are no plans set to auto renew.

Plan Extension Policy: There is no option to extend or add access time to any THE PILATES PARTY plans, including memberships & all a la carte purchases. There are no exceptions made to this policy.

Discount Code Policy: THE PILATES PARTY reserves the right to cancel or refuse any discount code at any time without notice. If a customer forgets to use a discount code at purchase, THE PILATES PARTY reserves the right to refuse to retroactively apply any discount code.

Content Privacy Policy: All purchases of THE PILATES PARTY content, including a la carte sessions and party memberships, are meant to only be used by the purchaser and cannot be shared with others. Sharing of login credentials is strictly prohibited and as a company we track IP addresses, login history & location, and profile history for suspected breaches of this policy. All purchased content only available to view by logging in with your registered account credentials and cannot be copied or downloaded to a personal device for viewing or listening offline. Violations of this policy are considered unlawful and THE PILATES PARTY reserves the right to take legal action in cases of misconduct.

Liability Waiver

I acknowledge that these sessions (the “Session”) are being conducted online without an instructor physically present and involves strength and flexibility exercises which can be potentially hazardous activities.

I am voluntarily agreeing to participate in the Session and I hereby agree to expressly assume and accept any and all risks of injury or physical harm. I acknowledge and represent that I am physically sound, and I do not suffer from any illness, impairment, disease or other condition that would prevent me from participating in the Session.

In consideration of being allowed to participate in the Session, I do hereby knowingly and voluntarily, on behalf of myself and my heirs and assigns, forever waive, release, discharge and hold harmless THE PILATES PARTY, their instructors, and any other affiliate and assigns from any and all liability, damages, losses, suits, demands, causes of action (including, without limitation, negligence) or other claims of any nature whatsoever, including, without limitation, any losses for property damage or personal injury, arising out of or relating in any way to my participation in the Session and its related programs and activities or my use of any equipment or machinery in connection with the Session.

I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during the Session.

I represent and acknowledge that I have read and understand this Virtual Pilates Liability Waiver and Release. The invalidity, in whole or in part, of any portion of the above paragraphs will not affect the remainder of this form. My voluntary execution of this form evidences my agreement to the terms, provisions, waivers and releases as set forth above.
