SUMMARY OF TERMS & POLICIES - NEXUS AUDIO
1. Agreement and Entry: By entering the studio premises or working remotely, individuals are bound by the terms collectively referred to as "Nexus Audio." Failure to adhere to these terms may result in ejection without a refund.
2. Reservation Policy: All sessions require a non-refundable 50% deposit, payable in cash, credit card, CashApp, or PayPal. Billing is in 15-minute increments, and full payment is required before delivering files to the client.
3. Cancellation Policy: "No Show" or cancellation without 48-hour notice results in forfeiture of the deposit.
4. Rights Reserved and Release of Liability: Nexus Audio reserves the right to refuse service, and entry is at one's own risk. Consent to video and sound recording is implied, and recordings may be used for promotional purposes. Damaging equipment or defacing the premises leads to eviction.
5. Client Responsibility: Clients are liable for stolen or damaged equipment and assume responsibility for all members of their party. Nexus Audio is not responsible for loss, injury, or damages. Protective measures are advised during live instrument recordings.
6. Session Booking, Deposits, Balances, and Cancellations: A 50% deposit is required for session booking. Cancellation or rescheduling with less than 48 hours' notice results in forfeiture of deposits. Cancellation within 48 hours incurs a fee of 50% of the session cost.
7. Studio Unavailability: If the studio becomes unavailable during a session, Nexus Audio reserves the right to cancel, refunding unused studio time. Nexus Audio will make efforts to provide notice but is not liable for any resulting costs or damages.
8. Archival and Delivery of Mix Data: Nexus Audio retains intellectual property rights to its mixing methods. Mix data, including plugin settings and Pro Tools session files, is not provided. Uncompressed audio files or processed stems can be obtained at the engineer's hourly rate, provided the client's account is in good standing.
9. Gift Certificates are transferable but expire after two years.
