TERMS AND CONDITIONS

- Skin and body adjustments, and removal of subjects are subject to a surcharge.
- Allergies, wounds, dermatitis are subject to a surcharge
- Package purchased valid for ONE year
- Daniel Tam Art Gallery Limited reserved all the copyrights on media contents (photo and video) generated during the shooting. Clients have lifetime usage rights on photos.
- Payments made prior to the shooting day are non-refundable and non-transferable.
- Client declares that is aware of Daniel’s and Daniel’s crew's portfolio and understands that perception is subjective, and thus accepts the style of shooting, processing and colourings of the photos as Daniel absolutely deems fit.
- Daniel is the copyright owner of all the media (including photos, videos, and behind the scenes) created during the shooting and has the right to use all media produced for education, competitions, exhibitions, editorial, display purposes, creating educational content and all kinds of commercials and non-commercial's purpose. In case the Client wishes to purchase the full copyright of the photos, a surcharge of 2000% of the package price will be imposed. In such a case, all images will not be used for any of the above-stated purposes and will be deleted within 2 weeks after delivery.
- The “making of” video is ONLY for Daniel’s reference and Daniel has absolute rights to editing and ways of usage.
- Photographic lead time is about 2-4 weeks after the client selects the photos to retouch.
- Body and skin retouching, removal of or adding in stuff are not considered digital photograph touch up effects. Special effects are subject to a surcharge.
- All files are delivered online with a link to download; the link will expire in 90 days.
- Under severe weather conditions when Typhoon Signal 8 or rainstorm warning signal is hoisted and announced by the Hong Kong Observatory, Daniel’s photographic service MUST be suspended for safety reasons. Any postponement of the service date is subject to Daniel’s working schedule.
- In the unlikely event that any photographs/videos have been lost, stolen, or destroyed for whatever reason, the limit of liability for partial loss of originals shall be pro-rata amount of the exposures lost based on the percentage of a total number of originals.
- For the avoidance of doubt, the maximum liability of Daniel for any valid claims including any claim for losses and damages etc. would be capped at the full refund of all payments received.
- Clients must take care of their own belongings and personal safety during the shoot. Clients also understand all the risks that incur during the shoot. Daniel himself and Daniel Tam Art Gallery will NOT be responsible for any loss or injuries/accidents happened / accidental death during the shoot.

-For shooting below HK$15000, if the Client wishes to change the shooting date (other than due to severe weather conditions), the following surcharge would be imposed for administrative costs and penalty charges. The rescheduled shooting date is subject to Daniel's working schedule.
(a) at any time no less than 14 days before the originally scheduled shooting date, the Client acknowledged and agreed that Daniel is entitled to impose a surcharge of $1,000.
(b) at any time in between 7 days to 14 days prior to the originally scheduled shooting date, the Client acknowledged and agreed that Daniel is entitled to impose a surcharge of $1,500.
(c) at any time less than 7 days of the originally scheduled shooting date, the Client acknowledged and agreed that Daniel is entitled to impose a surcharge of $3,000.
- For shooting equal to or above HK$15000, If the Client wishes to change the shooting date (other than due to severe weather conditions)
(a) at any time no less than 30 days of the originally scheduled shooting date, the Client acknowledged and agreed that Daniel is entitled to impose a surcharge of 20% of the total contract sum representing administration costs and penalty charges. The client shall also be held responsible for all disbursements and incidental expenses already incurred by Daniel. The rescheduled shooting date is subject to Daniel's working schedule.
(b) at any time less than 30 days of the originally scheduled shooting date, such change is deemed a cancellation/termination of the original service package and a new booking with new charges afresh will be imposed.
