To ensure that I continue providing you with a high-quality, efficient, and flexible training experience, we are updating our policies regarding session cancellations, rescheduling, and the management of your session bank. These updates are designed to ensure fairness and clarity for both you as the client and myself as the trainer.

Please review the following updates carefully. These policies are designed to clarify expectations and responsibilities on both sides, and they will take effect immediately. Should you have any questions or concerns, I am happy to discuss them with you.

1. Cancellation and Rescheduling Policy

General Cancellation and Rescheduling Requirements: • All cancellations or rescheduling requests must be made at least 12 hours prior to the start time of your session. This policy is in place to ensure that both your time and mine are respected, and to allow for appropriate scheduling adjustments. • If you cancel or attempt to reschedule a session within 12 hours of the scheduled start time, the session will be considered completed and deducted from your total session count as though the session took place. No rescheduling will be allowed for a session canceled within this timeframe.

How to Reschedule: • To reschedule a session, you can use the provided scheduling and rescheduling link. Rescheduling is allowed as long as you initiate the change at least 12 hours before the scheduled session time. • Please note that rescheduled sessions are subject to the same cancellation and rescheduling rules as regular sessions. This means that if you reschedule a session and need to cancel again, the same 12-hour cancellation notice is required, and the same policies will apply.

Reminders: • If you reschedule a session within 12-24 hours of its start time, this rescheduling action will serve as your reminder, and no additional reminder may be sent. • Please ensure you keep track of your schedule and plan accordingly. While reminders may be provided, it remains your responsibility to manage your calendar and know your session times.

2. No-Show Policy

• If you fail to attend a session without providing any notice (i.e., a “no-show”), the session will be considered completed and counted toward your session total. No refunds or rescheduling will be allowed for no-shows, and it will be treated as though the session took place. • This policy helps ensure that all sessions are accounted for and scheduled time is respected. It is crucial that you notify me in advance if you cannot attend.

3. Late Arrival Policy

• If you arrive late to a session, the session will still conclude at the originally scheduled end time. Session times will not be extended due to late arrival, as this would impact other clients’ scheduled times and disrupt the overall schedule. • At my discretion and depending on availability, I may be able to extend the session to make up for the time lost due to late arrival, but this is not guaranteed and will only be offered if it does not interfere with other commitments. This applies to "pushing" or "moving up" session requests as well (i.e. instances where you would like to push the session 30 minutes later) • In the event that your session is about to end early, you may request to use the remaining scheduled time for additional training activities, questions, or consultations. However, the session will still be considered completed at the originally scheduled end time.

4. Session Bank Policy (For non-subscription packages and purchases)

Banking Eligibility: • When a session is canceled with at least 12 hours’ notice, our first priority will be to reschedule the session at a mutually convenient time. However, if rescheduling cannot occur immediately, the session will be added to your "session bank" for future use.

How the Session Bank Works: • If a session is canceled with proper notice but not rescheduled immediately, it will be added to your session bank. Banked sessions allow you the flexibility to reschedule them at a later time that suits your schedule. You can use them at any available training time by utilizing the Acuity scheduling link found in the "Forum's" section of the Everfit App. Session Bank Time Limits (for non-subscription packages and purchases): • Banked sessions will last Six (6) months from day of purchase. Afterwards they will expire and will no longer be useable.

5. Refund Policy

Refunds for Accidental Purchases: • Refunds will only be provided in cases of accidental purchases or billing errors. If you mistakenly purchase a session or package that you do not intend to use, please notify me immediately so that the issue can be resolved.

Non-Refundable Banked Sessions (for non subscription plans and purchases): • Banked sessions are non-refundable. As preparation and planning have already been completed for scheduled sessions, including those that are banked, no refunds will be issued for unused or banked sessions.

Refunds for Special Circumstances:

• Refunds for special circumstances, such as emergencies, illness, or injury, will be considered on a case-by-case basis at my discretion. While I aim to be understanding of genuine emergencies, refunds will only be issued if the situation truly prevents training. Please refer to the “Special Circumstances” section below for further details.6. Special Circumstances (Illness, Injury, or Emergencies) I understand that life can be unpredictable, and unexpected events such as illness, injury, or emergencies may arise that prevent you from attending or participating in your sessions. • If you experience a sudden illness, injury, or emergency that makes it impossible for you to attend or complete a session, exceptions to the 12-hour cancellation policy may be made at my discretion. This means you may be allowed to reschedule or bank the session even within the 12-hour window, depending on the nature of the situation. • Additionally, package refunds for emergencies or health-related issues will also be at my discretion and considered on a case-by-case basis. While I strive to be understanding in cases of genuine need, I also want to ensure that these policies are not misused. In some cases, I may request documentation, such as a doctor’s note, to approve exceptions.

7. Technical Issues and Notifications When dealing with app technology like Everfit or Acuity, technical issues may occasionally occur.

• If you do not receive a notification or reminder due to a technical issue, it remains your responsibility to keep track of your scheduled sessions. Technical problems on the users behalf will not be treated as special circumstances, and the standard cancellation and rescheduling policies will still apply. • To avoid any confusion or missed sessions, I strongly recommend keeping your own record of scheduled sessions, even with reminders in place.

8. Holiday and Travel Policies Trainer Holidays or Absences:

• I will notify you in advance of any holidays, vacations, or planned absences that may impact your regularly scheduled sessions. During these times, sessions may be paused or rescheduled to accommodate the time away. Client Holidays or Absences: • If you have planned vacations or absences, please notify me in advance. The standard 12-hour cancellation and rescheduling policies still apply during your absence, so it’s important to plan accordingly. Banked sessions for non-subscription packages can be used to accommodate travel, but no sessions will be refunded or cashed out if they are not used during your absence.

9. Suspension of Training.

If you experience a longer-term injury, illness, or health concern that temporarily prevents you from continuing your training, you may request to suspend your subscription. During this time, no sessions will be deducted from your account, and any existing banked sessions for non-subscription packages will remain available when you are ready to resume training for six (6) months. Suspension of training is recommended if the client has accrued a significant amount of banked sessions. I will attempt to notify the client of their banked session amounts on a monthly basis, however it is ultimately on the client to request a suspension of payment for the purpose of utilizing their banked sessions. • I may request documentation from a healthcare provider to approve the suspension of training. This ensures that the policy is applied fairly and consistently across all clients.

10. Monthly Subscription Model & Session Expiry Policy Subscription Plan Structure:

• LMS Personal Training now offers training on a monthly subscription model, where clients are allotted a set number of sessions per billing cycle (e.g., 12 sessions per month, etc). • Sessions do not roll over to the next billing cycle. If you do not use and/or schedule all of your sessions before the end of the billing cycle that they were allotted for, then they will expire at the start of the next billing cycle. • This policy ensures fairness and encourages consistency in training while maintaining an efficient scheduling system. Rescheduling Unused Sessions: • If you have any unused session in a given months bling cycle, you may reschedule that session for any available future time—as long as: • The rescheduling request is submitted before the next billing cycle begins, otherwise you will be given a new set of sessions, and • The session you are rescheduling was canceled at least 12 hours in advance as per regular rescheduling policy. • If a session is not scheduled/rescheduled before the next billing cycle, it will be forfeited and cannot be carried over. These sessions can be rescheduled for no more than 45 days from day of attempt to reschedule.

11. Transfers of Subscriptions and Sessions:

If you wish to transfer your subscription or banked sessions to another person, you are welcome to do so under the following conditions: • The new client must complete the onboarding process to become an official client. • The new client will be subject to all the policies outlined in this document, and the transfer must be confirmed by both parties in writing.

12. Payment Terms and Auto-Renewal Payment Due Date:

• Payments for your subscriptions are due at the start of each billing cycle. If payment is not received by the due date, sessions will be paused until payment is completed. Auto-Renewal: • Subscriptions are set to auto-renew each month at the start of the billing cycle unless you notify me (Landry) in advance of your intent to cancel, which can be done at anytime. If you plan to cancel or modify your package, please inform me at least one week before the next billing cycle to avoid any issues.

13. Policy Acknowledgment and Effective Date"

This policy update is effective immediately. By continuing to use my training services, you agree to adhere to these updated terms and conditions. If you have any questions or need further clarification on any of the policies outlined, please reach out. Thank you for your understanding and cooperation as we implement these updated policies. They are designed to ensure that your training experience is efficient, flexible, and fair for both parties.

If the individual attempting to purchase this is under the age of eighteen (18) years old, then they should refrain from purchasing until consulting their parent and/or legal guardian.
