These terms and conditions govern your participation in any activities, therapies, or consultations conducted by or on behalf of Esprit Conscient Trust trading as Lionheart Integrative Therapies and its representatives. By accessing and using our services, you agree to comply with these Terms and Conditions.

In this document, Esprit Conscient Trust trading as Lionheart Integrative Therapies, and its representatives are referred to as "Lionheart." Any therapist, instructor, coach, or practitioner operating on behalf of Lionheart is referred to as "the practitioner." Any appointment, class, or session is referred to as "the booking." Any program, workshop, or methodology is referred to as "the program.

1. Personal Information and Confidentiality

1.1. To engage with the services provided by Lionheart, I consent to the collection, storage, and use of my personal and health information in accordance with Australian Privacy Laws.

1.2. I understand that all information provided is confidential and will not be released to third parties without my consent, except as required by law or to ensure safety.

2. Before the Booking

2.1. I am responsible for informing the practitioner of all known current or previous medical conditions, surgeries, injuries, and medications.

2.2. I acknowledge that the services offered by the practitioner are complementary and not a substitute for medical advice or treatment.

2.3. The practitioner is reasonably qualified in their field of practice and will operate within the scope of their professional capacity.

2.4. The practitioner may perform joint mobilizations, manipulations, deep tissue massage, visceral mobilizations, electrotherapies, vibration therapy, sound therapy, heat therapy, yoga therapy, breathing therapy, talk therapy, reiki therapy, movement therapy, and vigorous exercise. manual therapy, guided movement, sound therapy, breathwork, and other modalities. I warrant that I am physically and emotionally fit to participate in these modalities.

2.5. I may be required to actively participate in the treatment process and understand that outcomes are collaborative.

2.6. If I cancel or fail to attend a booking within 24 hours of the scheduled time, I may be charged the full fee for the session. Prepayment may be required for future bookings following a late cancellation or no-show.

2.7 I am responsible for informing the practitioner or instructor of all known current or previous medical conditions, surgeries, injuries, and medications.

2.8 The treating physiotherapist is qualified to diagnose musculoskeletal, neurological, and cardiorespiratory injuries, diseases, and disorders.

3. During the Booking

3.1. I understand that I may experience physical or emotional discomfort during therapies. If I feel pain or unease, I will immediately inform the practitioner.

3.2. The practitioner may use tools, techniques, or equipment during the session. I agree to inform the practitioner of any adverse reactions or concerns immediately.

3.3. If I feel uncomfortable with any treatment or therapy, I will communicate this to the practitioner, who will cease the activity causing discomfort.

3.4. I understand that some modalities, such as spinal manipulations, may carry risks, including but not limited to soreness or adverse reactions, and I consent to these treatments. The physiotherapist may perform spinal manipulations with my consent, I understand that there is a low risk of stroke, nerve injury, headaches/migraines, and discomfort following a manipulation.

3.5 During a booking, I may receive on-body manual therapy. If I feel uncomfortable with any treatments provided at any time, I will immediately inform the practitioner who will immediately cease the specific treatment that is causing me to feel uncomfortable.

4. After the Booking

4.1 I may not be fit to drive, operate machinery, or engage in ordinary or vigorous physical activities.

4.2 I accept full responsibility for all actions and decisions made following my participation in a booking.

4.3 I release Lionheart from all liability for the coming into existence, aggravation, or acceleration of an injury, disease, or condition as a result of my participation in treatments, therapies, or activities conducted by Lionheart other than liability for significant personal injury caused by reckless conduct (within the meaning of section 139A(5) of the Competition and Consumer Act 2010) by Esprit Conscient Trust and its representatives.

4.4 I am responsible for the outcome of undertaking any recommended exercises or practices.

4.5 I will inform the practitioner of any relevant changes in my health and physical condition after I participate in a booking.

4.6 All nutritional and supplemental advice provided to me by the practitioner is advice only and does not substitute for medical treatment. I accept full responsibility for all food, liquid, and supplements that I consume.

4.7 It is my responsibility to seek appropriate medical approval before changing my nutritional and supplement intake.

4.8 I accept full responsibility for any consequences of following any nutritional or supplemental advice provided to me by the practitioner.

5. Refund Policy

5.1 Refunds for bookings, programs, or services will be considered on a case-by-case basis and are at the sole discretion of Lionheart, in compliance with Australian Consumer Law.

6. Payment Plans and Memberships

6.1 Lionheart offers payment plans and memberships for its services, in compliance with relevant laws and regulations, including the Australian Consumer Law.

6.2 Payment plans and memberships are subject to specific terms and conditions outlined by Lionheart at the time of enrolment.

6.3 By enrolling in a payment plan or membership, you agree to abide by the terms and conditions set forth by Lionheart.

6.4 Lionheart ensures transparency and fairness in its payment plans and memberships, providing clear information regarding payment schedules, cancellation policies, and any other relevant guidelines.

6.5 Lionheart reserves the right to modify or terminate payment plans and memberships at its discretion, with reasonable notice provided to participants.

6.6 Any outstanding payments under a payment plan or membership must be settled promptly to maintain access to Lionheart's services.

6.7 Failure to adhere to the terms of a payment plan or membership will result in termination of services

7. Intellectual Property

7.1 All intellectual property associated with Lionheart's services, including but not limited to written, digital, media, or printed content, materials, and methodologies, remains the property of Lionheart. Any unauthorized use or reproduction is prohibited.

8. Declaration and Release from Liability

8.1 The information I provided before, during, and after the booking, to my knowledge, is true and correct and I have not omitted any information that was requested during my participation or by this form.

8.2 I release Lionheart from any liability, claims, or damages of any kind whether in contract, tort (including negligence), or otherwise, past, present, and future relating to my participation in therapies and activities provided by Lionheart to the maximum extent permitted by the law.

8.3 Where the participant is under 18 years of age, this form must be completed by the Participant's parent or legal guardian.

9. As the Legal Guardian of the Participant

9.1 I authorize and consent to the participant participating in treatments, therapies, or fitness-related activities at Lionheart.

9.2 I expressly agree to be responsible for the participant's behavior.

9.3 I acknowledge and agree that the participant's participation in any treatments, therapies, or fitness-related activities conducted by Lionheart or its representatives is subject to the above terms and conditions.

10. The Physical Freedom Method (TPFM)

10.1. I understand that consultations and services under TPFM are not a substitute for medical treatment and do not establish a formal patient-practitioner relationship.

10.2. I acknowledge that recommendations and insights provided during sessions are collaborative and require my active participation and judgment.

10.3. I consent to participate in TPFM sessions for self-improvement, goal setting, and personal development, and take full responsibility for my actions and decisions.
