Service Agreement

Definitions:
“Client” herein refers to you, the named individual below.
“Trainer” herein refers to any dog trainer employed by Biggie Paws, LLC.
“Dog” herein refers to your canine who has been enrolled in a program with Biggie Paws, LLC.

Effective Date: This Agreement shall be effective as of the date Client signs the Agreement.

Training Fees: Fees are due at the time the session is scheduled in order to reserve that date/time. Training package fees are due up front to secure current pricing.

Training Tools: Biggie Paws may use the following tools for training, walking, or pet sitting: (This is not an exhaustive list)

-Blue-9 Balance Harness

-Two Hounds Freedom Harness

-Long line (15-30 ft. non-retractable leash)

-Toys/Enrichment (KONGs, Lickimats, ropes, puzzles, etc.)

-Food rewards/treats

-Crate/Playpen

-Various other tools that are aligned with Fear-Free, Force-Free, Pain-Free methods

Client hereby acknowledges that Trainer will not use and Client agrees they will not use, now or in the future, any of the following aversive tools: Prong Collar (metal or plastic), Choke Collar, Electronic Shock Collar (E-Collar), Citronella Spray Collar/Water Spray Collar. Trainer will also not use Slip Leashes, Gentle Leaders, or any other aversive tools.

Cancellation Policy: If Client fails to give at least 48 hours’ cancellation notice or is not present at time of scheduled appointment, a fee will be assessed and you will be charged immediately. The fees are as follows: $50 for any training session, $25 for any walking or pet sitting visit. The missed session will be rescheduled normally once the fee has been paid.You may also elect to forfeit that session. Excessive cancellations (3 or more in any package) can result in an early termination of your training program or pet service package and no refund will be given.

Private Training Sessions Refund Policy: If Client cancels a training package before the first session has occurred, Client will pay a $75.00 administrative fee to proceed with the package cancellation and receive a refund of the remaining total after the fee deduction. After the first training session is conducted, Client shall be eligible for a refund of up to 50% of the remainder of sessions up until the expiration date listed in the Term below.

Scheduling Policy: It is the responsibility of Client to follow the training program created by Trainer. Client is responsible for scheduling any/all sessions via the Acuity scheduling portal before the expiration date of their session(s), which is no more than 180 days from the date of purchase. The trainer may be up to 10 minutes early or 10 minutes late depending on traffic patterns, weather conditions, or other circumstances.

Severe Inclement Weather Policy: Biggie Paws, LLC reserves the right to cancel any appointment due to severe inclement weather and/or unsafe driving conditions. Every effort will be made to keep the appointment, including a potty break and inside playtime, training inside only, etc. However, if conditions are unsafe or the training cannot be conducted effectively, the appointment will be rescheduled with no penalty fee.

Liability: If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer’s agents from any resulting claims, demands, lawsuits, losses, costs, or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

Emergency/Vet Care: Client hereby grants permission to Biggie Paws, LLC, to act on their behalf, and in their pet’s best interest, by obtaining veterinary care, should deem it necessary for the health and well being of Dog(s) while in the care of Biggie Paws, LLC. Client further agrees to pay for or reimburse the cost of any and all veterinary or reasonable necessary services whose costs Biggie Paws may incur. Further, Client attests that Dog(s) are up-to-date on all vaccinations and will provide proof of it. Client also attests that Dog(s) does not suffer from any life threatening or contagious condition that may be exacerbated by exposure to other pets, or expose other animals to undue risk while in Biggie Paws’ care.

Term: This Agreement shall be effective as of the Effective Date and continue until the earlier of (i) the date that is one hundred and eighty (180) days from the Effective Date or (ii) all Services described herein have been rendered to Client. The obligations of each party shall survive the termination of the relationship, to the maximum extent permitted by law. Notwithstanding the foregoing, at Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect. For the avoidance of doubt, this Agreement shall expire on ____(month)_____(day)_____(year) (trainer initials:________, client initials:________).

This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above.

The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time.
